General Terms and Conditions of the CROATIAN SPORTS MUSEUM

  1. Introduction

These General Terms and Conditions govern the relationship between the Croatian Sports Museum, with its registered office in Zagreb, Praška ulica 2/II, PIN: 61689362030 (hereinafter: HŠPOM), and the user of the application (hereinafter: the User), as well as the methods and conditions for booking and purchasing tickets through the application provided by HŠPOM to Users.

  1. Definitions

For the purpose of these General Terms and Conditions, the following words shall have the following meanings:

  • User refers to any natural person who uses the HŠPOM application
  • Ticket refers to an admission ticket for museum visits, guided tours, educational workshops, etc., offered for sale via the HŠPOM application
  • Annual Ticket refers to an admission ticket for museum visits, valid for one year from the time of purchase
  • Service refers to the sale of tickets for museum visits, guided tours, educational workshops, etc.
  • Order refers to the User’s request to purchase a ticket via the HŠPOM application.

Gender-specific words used in these General Terms and Conditions are to be understood as gender-neutral and apply equally to all genders.

  1. Subject of the contract

The subject matter of this contract is the sale of Tickets offered by HŠPOM through its application and the provision of other services related to museum visits, all in accordance with these General Terms and Conditions.

  1. Prices and Payment

The prices of all Tickets listed in the HŠPOM application are expressed in euros. In accordance with the Value Added Tax Act, VAT is not applied to the stated prices. Payment may be made via bank cards. The prices displayed in the application at the time of placing the order apply to that specific order. HŠPOM reserves the right to change prices without prior notice, except for orders that have already been confirmed. Certain Tickets may be subject to discounts or promotional offers. Details of such discounts and promotions will be provided in the application or in separate notifications.

  1. Tickets at preferential rates

HŠPOM offers Tickets at preferential rates for certain categories of visitors, including children up to the age of __, pensioners, members of sports federations, employees of _____, group visits, and in other cases as specifically determined by HŠPOM.

  1. Order and conclusion of contract

All services offered by HŠPOM and published in the application constitute an invitation to users to submit a binding offer for the selected Service. The User submits a binding offer by clicking the “Buy” button. The sales contract between the parties is deemed concluded once HŠPOM sends a confirmation of order acceptance to the email address provided by the User or issues a specific confirmation within the application indicating that the purchase was successful. The User places the order through the HŠPOM application.

After selecting the desired Services, the User is required to enter personal data into the order form, such as their name and surname and, if applicable, an email address.

To proceed with the purchase, the User must first accept these General Terms and Conditions by ticking the designated checkbox.

Upon submission of the order, the User immediately pays the amount by entering their credit card details. After completing the purchase, the User’s credit card will be charged the actual invoice amount, which includes the price of the selected service.

  1. Online ticket purchase for the museum

Users can purchase tickets via the application for museum visits, guided tours, educational workshops and similar services. When purchasing, the User must select the appropriate options such as the number of visitors, date of visit, and guided tour. By clicking the “Buy” button, the User submits a binding offer to conclude a sales contract.

To be eligible for a preferential rate, the User must correctly enter the required information in the designated field. If the data provided is incorrect, or if the User does not meet the conditions for a preferential rate, the ticket shall be considered invalid, and HŠPOM reserves the right to deny the User entry to the museum.

If the ticket is purchased for a specific date and time, it is valid only for that date and the time stated on it and cannot be used for other dates or times.

The User must retain the purchased Ticket and present it to HŠPOM staff upon entry to the museum, either in printed or digital form.

HŠPOM reserves the right to cancel scheduled guided tours, educational programmes, and similar activities for organisational or safety reasons. In such cases, the User will be refunded the amount paid to the account from which the payment was made. HŠPOM will make reasonable efforts to inform the User of the cancellation in a timely manner via the email address provided.

Museum visits outside of regular opening hours or under special guidance are only possible by prior arrangement with HŠPOM. In the event of non-attendance or cancellation by the User, HŠPOM reserves the right to charge the full price of the service.

  1. HŠPOM’s liability for delays or cancellations

HŠPOM shall not be held liable for its inability to honour the booked time slot due to circumstances beyond its control, such as strikes, natural disasters, or restrictions imposed by competent authorities. In such cases, HŠPOM shall not be liable to Users for any resulting damage or incurred costs.

  1. Code of Conduct

The Code of Conduct forms an integral part of these General Terms and Conditions and, by purchasing a Ticket, the User agrees to comply with it. The Code of Conduct is available at the entrance to the museum and on HŠPOM’s website.

Users who do not comply with the Code of Conduct will be asked to leave the museum premises and will not be entitled to a refund for the ticket.

  1. Right to complaint

The User has the right to file a complaint if their order was not processed correctly or if an error occurred during the use of the application. If the complaint is accepted, HŠPOM will offer the User either a replacement service or a refund.

  1. Termination of contract

HŠPOM reserves the right to terminate the sales contract if it is subsequently determined that the User has not paid the full purchase price, or has not paid at all. In such cases, HŠPOM may deny the User entry to the museum.

In the event of contract termination, any amount paid will be refunded to the User’s account from which the payment was made. The User shall not be entitled to statutory default interest on the refunded amount. HŠPOM shall not be liable for any damage caused to the User as a result of contract termination, unless such damage was caused intentionally or by gross negligence on the part of HŠPOM’s employees.

  1. Copyright and intellectual property

The author of the content of this application—including texts, photographs, videos, logos, and other materials—is HŠPOM or the person credited in the source list. All documents, images, texts and other materials available through the application, as well as the application itself, are protected by the Copyright and Related Rights Act. Any reproduction, distribution, modification, or publication of the information contained in the application for commercial purposes is not permitted without the prior written consent of HŠPOM. An exception applies for personal, non-commercial use, and for journalistic or academic purposes, provided that the source is accurately cited and a copy of the published article or a link to access it is submitted.

  1. Liability

All information published in the application has been reviewed by HŠPOM’s staff to the extent reasonably possible prior to publication. Nonetheless, HŠPOM does not guarantee the accuracy or completeness of the information published in the application but will endeavour to correct any identified deficiencies as soon as possible. HŠPOM shall not be liable for any damage resulting from the use of the application, except where such damage is caused intentionally or by gross negligence on the part of HŠPOM staff. If the application contains links to third-party websites, HŠPOM shall not be held liable for their content.

  1. Dispute resolution and applicable law

All disputes between the User and HŠPOM shall primarily be resolved amicably. If an amicable resolution cannot be reached, jurisdiction shall lie with the Municipal Civil Court in Zagreb.

By accepting these General Terms and Conditions, the User agrees to the application of the law of the Republic of Croatia.

 

  1. Amendments to the General Terms and Conditions

HŠPOM reserves the right to amend these General Terms and Conditions at any time. Such amendments shall enter into force upon their publication on the website.

 

  1. Personal data protection

HŠPOM shall store all personal data of Users in accordance with applicable personal data protection regulations. Personal data will be used exclusively for the purpose of providing our services. HŠPOM undertakes all reasonable measures to protect Users’ personal data from loss, misuse, unauthorised access, disclosure, alteration, or destruction. HŠPOM uses secure data transmission protocols and has implemented technical and organisational measures to safeguard personal data. However, HŠPOM cannot guarantee absolute data security.
